Peckford says give the charter a chance

Judges have ruled that the clear infringements of constitutional freedoms were justified under Section One of the Charter, which reads, "The Canadian Charter of Rights and Freedoms guarantees the rights and freedoms set out in it subject only to such reasonable limits prescribed by law as can be demonstrably justified in a free and democratic society."
Peckford says governments have not
"demonstrably justified" their pandemic responses, nor shown "reasonable
limits" in their execution.
